2. The Panda Pledge™ & Maintenance

We Love Paving offers a limited 15-year warranty known as the Panda Pledge™ (the “Pledge”), a conditional maintenance program designed for long-term asset protection.

Warranty Integrity: Failing to perform the prescribed maintenance to the Pledge’s specifications, or failing to document it as required, may void the Pledge.

Maintenance Obligation: To keep warranty coverage active, the property must receive periodic sealcoating and inspection within the intervals stated in the Pledge (generally every 3 to 4 years).

Qualified Providers: This maintenance may be performed by We Love Paving or by another properly licensed C-12 or C-32 contractor, provided the work is performed to the specifications in the Pledge and documented to We Love Paving’s reasonable satisfaction. We Love Paving will not unreasonably withhold approval of a qualified third-party contractor for this purpose.

3. ADA Compliance Liability Shield

While we specialize in ADA upgrades for HOAs and commercial real estate, these regulations are subject to varying local interpretations:

• WLP is not liable for lawsuits or penalties resulting from pre-existing site conditions that prevent full ADA compliance.
• Compliance is guaranteed only to the extent of the specific scope of work outlined in a signed written Service Agreement.
• We are not a Certified Access Specialist (CASp) and do not provide legal ADA compliance evaluations.

4. Limitation of Liability & Technical Specifications

Scope. These exclusions apply to the Site and, to the extent not addressed by a signed Service Agreement, to work performed by We Love Paving. Where a signed Service Agreement contains its own risk-allocation provisions covering the same subject matter, the Service Agreement controls.

To the maximum extent permitted by California law, We Love Paving shall not be held liable for:

• Weight Overload: Damage caused by vehicles exceeding the designed load specifications (e.g., heavy-duty zones designed for 55,000 lbs vs. residential zones designed for 15,000 lbs).
• Unmarked Utilities: Damage to underground structures not accurately marked by the property owner prior to construction.
• Geological Shifts: Cracking caused by natural earth movement or extreme weather conditions typical of Northern California.

5. Intellectual Property & Portfolio Protection

All project images, “Panda” branding, and case studies are the exclusive property of We Love Paving, Inc. Unauthorized commercial use of our media to represent third-party work is strictly prohibited.

6. Communications Consent

By contacting us or submitting a form, you agree that We Love Paving may use the information
you provide to respond to and follow up on your request. Our practices regarding monitoring or
recording of calls, messages, and form submissions, including the notice provided at the start of
recorded calls, are described in our Privacy Policy at https://www.welovepaving.com/privacy-policy/, which governs communications consent. Your information is otherwise handled in accordance with that Privacy Policy.

7. Website Accessibility

We are committed to providing a website that is accessible to all users, including individuals with disabilities. We strive to follow applicable accessibility guidelines, such as the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, on an ongoing basis. 8. Copyright Complaints (DMCA)

If you believe content posted on this Site, including comments, infringes your copyright, please send a written notice to our designated agent at [email protected], including: a description of the copyrighted work; the location of the allegedly infringing material on the Site; your contact information; a statement of good-faith belief that the use is unauthorized; and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on behalf of the copyright owner. We will respond in accordance with the Digital Millennium Copyright Act, including removing or disabling access to material identified in a valid notice.

9. Indemnification

You agree to indemnify and hold We Love Paving, Inc., its officers, employees, and agents harmless from any claims, damages, or expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, your violation of these Terms, or content you submit to the Site, including any comments or uploaded media that infringe the rights of a third party.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

11. Entire Agreement

These Terms, together with any signed Service Agreement, are the entire agreement between you and We Love Paving regarding the subject matter of these Terms and supersede prior understandings on that subject. Our Privacy Policy describes how we handle personal information and is incorporated by reference for that purpose only; it is not intended to create contractual rights or obligations beyond those it independently states, and we may update it as described in the Privacy Policy itself.
